Terms and Conditions of use of Gardens and Homes Direct

3. Contract with customer
The contract between GHD and the customer comes into existence upon GHD acceptance of the customers order i.e. when payment has been received. GHD is entitled to withdraw from contracts in the case of obvious typographical or arithmetical inaccuracies appearing on GHD Web site.

4. Pricing and Availability
The prices of the goods are those specified on GHD Web site. The price, as displayed, is inclusive of VAT (at the standard UK rate). There will be an additional charge for delivery. Orders are subject to availability. In the unlikely event that the goods are unavailable, the customer will be notified by Email. Price and availability information is subject to change without notice.

5. Delivery of Goods
GHD will deliver the goods ordered to the delivery address supplied by the customer. Availability permitting, all orders paid for by credit card will be delivered within 7 to 14 days. Orders paid for by cheque require 3 days for clearance and are then despatched in the same way. GHD is entitled to deliver in part. Despatch of goods constitutes fulfilment of contract.

6. GHD Warranty
If the goods delivered are not what the customer ordered, or are of incorrect quantity, or are damaged or defective, GHD will, if the customer returns them within a reasonable period, at the customer's option either give a full refund or where possible make good any shortage or non-delivery or replace any damaged or defective goods.

7. Return of goods - 100% money back guarantee..
If for any reason the customer is unhappy with their purchase, they can return it to GHD for an exchange or refund, providing GHD receives it within 15 days from the date of its original receipt by the customer. GHD must be contacted on 0800 389 0607 (office hours only) prior to the return of the items. Returned products must be received by GHD in good condition and all component parts, including any promotional products that may have been included in your purchase before refunds can be given. A note explaining the reason for return should also be enclosed. This does not affect your statutory rights. The customer bears the cost of returning goods for refund or exchange, except in cases of faulty, damaged or wrongly supplied goods. This is also known as a re-stocking fee, this fee can vary depending upon the size and weight of the item. GHD can arrange for collection of the item.

8. Governing Law and Jurisdiction
Contracts between GHD and the customer will be governed by English Law and all disputes will be submitted to the non-exclusive jurisdiction of the English courts.

9. GHD Reward Points
a. Gardens and Homes Direct has the right to terminate the program or to change the Terms and Conditions, regulations, benefits, conditions of participation, awards, and award levels, in whole or in part, at any time with or without notice, even though changes may affect the value of the points, awards or earning ability already accumulated.

b. Gardens and Homes Direct members may not provide their account number for use by others for the purpose of accruing points, benefits, promotion credit or awards. Members must be 18 years or older at the time of enrollment, points earning and award redemption. Access to account information will be given to no one except the member whose name appears on the account.

c. Gardens and Homes Direct reserves the right to terminate GHD Reward Points membership for anyone who appears to be utilizing the program in a manner inconsistent with the terms, conditions, or intent of the program or any portion of the program. All points in the account will be forfeited at that time.

d. You will not receive points for delivery charges or other incidental charges. You will not receive points for orders placed soley by telephone.

e. GHD Reward Points are not transferable and are void if sold for cash or other consideration.

f. If a member has any questions regarding GHD Reward points, point activity or point earnings, no adjustment will be considered after 30 days from the date of the last transaction.

g. Gardens and Homes Direct members accounts may be closed and all GHD Reward Points forfeited at Gardens and Homes Direct discretion if an GHD Reward Points account has been inactive during a consecutive twelve (12) month period.

h. GHD Reward Points may not be used in conjunction with other offers, discounts or promotions.

i. GHD Reward Points will not be rewarded on orders which have redeemed existing Points.
